Legal policies

On instructing us to carry out any form of work, the client agrees to our Terms and Conditions of business contained herein. Please ensure that you read both pages fully before signing this document, and the attached contract.  A signed contract will be required prior to commencement of any work.

Privacy Policy

The Company respects the privacy of its Service users. Please refer to the Company’s Privacy Policy (found below) which explains how we collect, use, and disclose information that pertains to your privacy.  When you access or use the Service, you signify your agreement with the Privacy Policy as well as these Terms of Use.

Confidentiality
Both Angelina Virtual Assistant and The Client agree that all information provided to each other will be treated as strictly private and confidential. ​Angelina Virtual Assistant will not, at any time, either directly or indirectly, divulge or communicate any information that is proprietary to the client without prior consent, unless we are legally obliged to do so. ​Angelina Virtual Assistant is happy to sign a non-disclosure or confidentiality agreement, if requested by the client.

Rates
The rates and charges payable by The Client will be detailed in the contract. Please note that I charge a minimum fee of 1 hour per assignment. The hourly rate will be charged in increments of 15 minutes, rounded up to the nearest quarter hour. The hourly rates include a reasonable amount of telephone calls, postage, stationery etc. If a job involves a high level of expenditure on printing, international telephone calls etc. or any additional services (such as couriers) these will be billed at cost, and will be outlined and agreed before the work is carried out. 

Payment of fees
Payment terms are strictly 7 days by BACS from the date of invoice, unless agreed otherwise within The Client’s contract. Retainer services must be paid monthly in advance on the first of each month. An invoice will be sent 7 days prior to this. A maximum of 2 unused hours from the VA chosen package may be carried over to the following month. 
If the retainer package commences part way through a month, the first payment shall include the pro-rated amount for the partial month along with payment for the first full month. ​Angelina Virtual Assistant or the Client can cancel a retainer package at any time by giving 14 days notice. Failure to pay on time may result in a late payment charge being applied to the account. The late payment charge is 10% above the base rate. Overdue accounts may be passed to a debt recovery agent for collection. ​Angelina Virtual Assistant is not currently VAT registered.
 For Websites you will pay the first 50% payment of Fees to us in advance at the time that you submit your Order. Further payments will be upon completion and handover of the finished product. No further Services will be provided once an invoice becomes overdue. Remedies must be made before any future services will be provided. If payments are repeatedly late we reserve the right to refuse all future service provisions.
Legal action will be sought for invoices that go beyond 90 days.

Deposit
A minimum 50% deposit (minimum payment) is required before work commences for a new client. If the estimate for a project exceeds £300.00, ​Angelina Virtual Assistant reserves the right to request full payment of the quotation for work prior to starting the project.

Loss/Damage of Client property
Digital Angel will not be held responsible for any loss, damage or theft of documents, equipment or any items relating to tasks during transit to and from its premises. ​Angelina Virtual Assistant recommends that clients obtain a proof of postage as we will not accept responsibility for loss or damage to items going through the postal service.

Proof Reading/Editing
The client will remain responsible for checking work which we return and raise any queries forthwith thereafter within 7 days. Queries raised within this time will be amended free of charge. I will not be liable for any losses you might sustain arising directly or indirectly from our completing work, save in so far as the same arises directly from our negligence.

File Back-Up
Any client documentation will be held securely on file for 3 months after which it will be deleted. If you would prefer an alternative retention period, you are required to notify ​Angelina Virtual Assistant in writing before commencement of any work.InsuranceFor insurance purposes, I cannot accommodate client visits to ​Angelina Virtual Assistant’s premises.

Disclaimer and Applicable Law
Angelina Virtual Assistant cannot be held responsible for the end use or content of any material, document or other, produced or edited on behalf of a client. In the event of dispute this agreement will be governed by the law of England and Wales.

Your obligations
 Correct information:
 You must only submit to us information (whether Material, contact details or otherwise) which is accurate and not misleading and you must keep it up-to-date and inform us of any changes.

Your responsibilities
You must: 
-Co-operate with me;
-Provide me with any information we reasonably require in respect of the Services from time to time;
-Report any faults or suspected faults with or in the Services to us immediately upon discovery;
-License and configure any third party hardware and/or software necessary for the provision of the Services unless otherwise agreed;
-Ensure that all materials provided is suitable and prepared for use in conjunction with the Services;
-Be responsible for ensuring that, and you hereby warrant and undertake to us that, your use of the Services and any Material:
(a) does not infringe the privacy rights or Intellectual Property Rights of any third party;
(b) is not for the purposes of sending spam or other unsolicited emails;
(c) is not defamatory, obscene, abusive, malicious, indecent, harassing or discriminatory;
(d) conforms in all respects will all applicable laws, rules, regulations, bye-laws and codes of practice (including disability discrimination, intellectual property, privacy and data protection laws);

Warranty as to Material
You warrant that any Material is owned by you. It is your responsibility to make sure that you have all necessary rights and consents relating to your use of the Material in conjunction with the Services.

What I am not liable for
I shall not have any Liability in respect of any:
-indirect or consequential losses, damages, costs or expenses;
-loss of actual or anticipated profits;
-loss of contracts;
-loss of use of money;
-loss of anticipated savings;
-loss of revenue;
-loss of goodwill;
-loss of reputation;
-loss of business;
-ex gratia payments;
- loss of operation time;
-loss of opportunity;
-loss caused by the diminution in value of any asset; 
-loss of, damage to, or corruption of, data.

What happens next?
I’ll get back to you as quickly as we can, normally within five business days, but sometimes we might need a little more time to look into your complaint. If this happens, I'll contact you within this time to tell you:
– why I can’t respond in full to your concerns yet;
– when I'll be back in touch. In most cases, I finish looking into complaints within two weeks but if it takes longer, I'll update you on our progress regularly throughout this time. Where you are not satisfied with the final response from me, you also have the right to refer your complaint to Trading Standards.

Privacy Policy

Information Digital Angel collects
Digital Angel collects “Non-Personal Information” and “Personal Information” in the categories described below. 

Usage data
Digital Angel will process information about your use of our website and services (“usage data”). The usage data may include

The source of the usage data is Google Analytics.  
Digital Angel use Google Analytics software to collect information about how you use our site.  Digital Angel do this to help make sure the site is meeting the needs of its users and to help us make improvements, for example improving site search. The usage data collected is needed to:
(1) deliver the content of our website correctly
(2) optimise the content of our website as well as any advertisement
(3) ensure the long-term viability of our information technology systems and website technology
(4) provide law enforcement authorities with the information necessary for criminal prosecution in case of a cyber-attack.

How long you spend on each page
How you got to the site
What you click on while you’re visiting the site

Digital Angel doesn’t collect or store your personal information (for example your name or address) so this information can’t be used to identify who you are and we don’t allow Google to use or share our analytics data.

In order to process this information, we have obtained the user’s consent in the interest of monitoring and improving our website and services.

Notification data
Digital Angel may process information that you provide for the purpose of subscribing to our email notifications and/or newsletters (“notification data”). 
Our newsletter may only be received by the user if:
(1) the user has a valid email address and
(2) the user registers for the newsletter shipping.

A confirmation email will be sent to the email address registered by a user for the first time for newsletter shipping, for legal reasons, in a double opt-in procedure. The confirmation email is used to prove whether the owner of the email address as the user is authorised to receive the newsletter. When the user registers for the newsletter, Digital Angel also store the IP address of the computer system assigned by the internet service provider (ISP) and used by the user at the time of the registration, as well as the date and time of the registration. The purpose of the collection of this data is to legally protect Digital Angel by ensuring understanding of the possible misuse of the email address of a user at a later date. The personal information collected as part of a registration for the newsletter will only be used to send our newsletter.

The subscription to the newsletter may be terminated by the user at any time. The consent to the storage of personal data, which the user has given prior to the shipping of the newsletter, may be revoked at any time. For the purpose of revoking consent, a corresponding link for unsubscribing is found in each newsletter.

Enquiry data, correspondence data, and customer relationship data
Digital Angel may process information contained in any enquiry you submit to us regarding our services and products (“enquiry data”). If a user contacts us via email or via a contact form, the personal information transmitted by the user is automatically stored. 
The personal information may include:
(1) the user’s contact information
(2) the user’s name
(3) the name of the user’s employer
(4) the user’s job title or role
(5) the metadata associated with the communication
(6) and information contained in communications between the user and Digital Angel. 

Such personal data transmitted on a voluntary basis by a user to Digital Angel are stored for the purpose of processing or contacting the user, managing our relationships with customers, keeping records of communication with the user, and promoting our products and services to customers.

Digital Angel may process information that the users post for publication on our website or through our services (“publication data”). On our website the users can post information in the following ways:

Articles on this site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website.

HOW DIGITAL ANGEL USES AND SHARE INFORMATION

We do share Personal Information with vendors who are performing services for the Company, such as the servers for our email communications who are provided access to user’s email address for purposes of sending emails from us. 

Those vendors use your Personal Information only at our direction and in accordance with our Privacy Policy. In general, the Personal Information you provide to us is used to help us communicate with you. For example, we use Personal Information to contact users in response to questions, solicit feedback from users, provide technical support, and inform users about promotional offers.

We also aggregate Non-Personal Information in order to track trends and analyse use patterns on the Site. RETAINING AND DELETING YOUR PERSONAL INFORMATION

Angelina Virtual Assistant will retain your personal data as follows:
Email address will be retained until you manually request to be removed from our mailing list. This data is stored for the purpose of processing or contacting the user, managing our relationships with customers, keeping records of communication with the user, and promoting our products and services to customers.

IP addresses will be retained for a minimum period of 30 days and for a maximum period of 14 months. This data is stored to help ​Angelina Virtual Assistant improve the Service, customise the user experience and make informed business decisions.
